Council seat challenge to be dropped
Published August 31, 2007 at midnight
Denver Councilman Paul Lopez, who was facing the prospect of losing his seat over allegations he didn't meet residency requirements, can breathe easy.
A legal challenge to declare Lopez ineligible to represent District 3 in west Denver may be over soon.
Alfonso Suazo, campaign manager for JoAnn Phillips, who filed the complaint in Denver District Court after losing to Lopez in the June runoff, said Thursday they will ask to have it dismissed today or Tuesday.
"We feel that at this point in time, the city needs to move on," Suazo said.
Lopez was in meetings late Thursday and unavailable for comment.
But Gia Irlando, Lopez's campaign manager, said dismissing the complaint "would be great."
"It's obviously the right thing to do, but until we see the papers, we really can't comment on it," Irlando said.
Lopez was born and reared in District 3, but Phillips claimed he didn't meet the requirement of being a district resident for at least one year before the election. She cited traffic tickets and a voter registration card that listed Lopez's address as 3400 S. Lowell Blvd., which is in District 2.
Lopez has said that he's always considered his grandmother's house in District 3 to be his primary residence.
