Pair charged with felonies in Ecstasy case
Published August 18, 2007 at midnight
BOULDER - The man and woman arrested for allegedly having the ingredients for making Ecstasy at their south Boulder home were charged Friday with felonies that could land them more than 25 years in jail.
Debra Cerio, 41, and Carl Andrew Dubois, 29, were arrested Tuesday at 720 S. 46th St., where investigators say they had the "precursors" for making as many as 80,000 doses of Ecstasy with a potential street value up to $3.2 million.
Friday, in the small courtroom at Boulder County Jail, Cerio was dressed in a white blouse and beige slacks. She had bonded out after Boulder District Judge John Stavely set bail at $25,000.
Carl Andrew Dubois, 29, was dressed in prison garb and handcuffed, and remains in jail. He hasn't come up with his $60,000 bail.
Cerio's bail was lower because she is a homeowner and has ties with the community.
The charges for both: intent to manufacture a controlled substance and possession on illegal drugs, both class 3 felonies; and conspiracy to manufacture and distribute illegal drugs, a class 6 felony.
Both also got special offender status because the alleged lab is within 50 yards of a school, Summit Elementary.
The special offender status means that if convicted, the person has to serve at least the lower end of the "presumptive range" of the penalty. For a class 3 felony, that's six years, with 12 years being the maximum.
The arrest affidavits showed that the Boulder County Drug Task Force and the Drug Enforcement Administration seized acids, sulfates, pumps, gauges and a gas mask, all potentially helpful in making Ecstasy, a "club drug" popular among college students.
The pair will attend their preliminary hearing at 9 a.m. Sept. 6, where a judge will decide whether there is enough evidence against them to warrant scheduling a trial.
