Attorneys: Community thinks Shawna Nelson is guilty

Published August 10, 2007 at midnight

Attorneys for Shawna Nelson, accused of gunning down her lover's wife in January, say she can't get a fair trial in Weld County because of "pervasive community opinion that Ms. Nelson is guilty."

The motion asking for a change of venue in the murder case is just one of nearly 50 motions filed in the past week by Nelson's lawyers.

The attorneys argue in the motion that many in the community think "she deserves the death penalty or life in prison."

They say pre-trial publicity in most every media outlet in Greeley and the metro area has contaminated the jury pool, making a fair trial in Greeley impossible.

The trial centers around a love triangle involving Nelson, Greeley Police Officer Ignacio Garraus and his wife, Heather Garraus. Nelson, who is alleged to have had Ignacio Garraus' child while she was married to someone else, is accused of shooting and killing Heather Garraus on Jan. 23.
