Auman seeks release on bail

Lawyers: It's unlikely she'll be convicted of officer's murder

Defense attorneys are asking a judge to release Lisl Auman on bail, arguing it's unlikely she will be convicted of felony murder at a second trial.

In a motion filed in Denver District Court late Tuesday, Auman's lawyers said there is "substantial evidence" that the 29-year-old woman was not guilty of any burglary, which formed the basis for her felony murder conviction.

Auman has served seven years of a life sentence for events that left Denver police officer Bruce VanderJagt dead. He was shot by Matthaus Jaehnig, who killed himself after the fatal confrontation at a Denver apartment complex Nov. 11, 1997.

Auman had been with Jaehnig during a police chase from the mountains, but she was handcuffed and in police custody when VanderJagt was killed.

The Colorado Supreme Court overturned Auman's conviction in March because of problems with jury instructions in her 1998 trial. A new trial is scheduled for Aug. 22.

In their motion, Auman's attorneys argued that Auman was not involved in the burglary of her former boyfriend's room and that the boyfriend, Shawn Cheever, has recently said he left Auman a key to his place.

Others present that day say Auman went to the room of her former boyfriend simply to remove her own property after their break-up, the motion said.

Jurors acquitted Auman of first- degree burglary but convicted her of second-degree burglary, which was reversed by the Supreme Court.

The court let stand convictions for menacing and conspiracy to commit first-degree burglary, which carried a four-year prison sentence.

Auman's attorneys also argue she is unlikely to flee if released on bond because she has strong ties to the community. Her father, Don Auman, is willing to pledge $75,000 in equity in his home as security to obtain her release, the motion said.

Prosecutors have indicated they will oppose Auman's release. A bond hearing is set for June 21.
